Terms of Service

These Terms of Service ("Terms") govern your use of the TicketsSA website and services (the "Platform"). By creating an account, listing something, or making a booking or enquiry, you agree to these Terms. If you do not agree, please do not use the Platform.

1. Who we are and what we do

TicketsSA ("TicketsSA", "we", "us") operates an online marketplace that lets independent third parties ("Providers") list events, accommodation, experiences, equipment for hire and merchandise, and lets members of the public ("Customers") discover them and make bookings or enquiries.

We are a marketplace, not the seller. Unless a listing says otherwise, the contract for any ticket, stay, experience, hire or purchase is directly between the Customer and the Provider. TicketsSA does not own, operate, manage or control any listed event, property, experience or item, and is not a party to that contract.

2. Accounts

  • You must be at least 18 years old and legally able to enter into contracts to hold an account.
  • You must give accurate information and keep it up to date, and keep your password confidential. You are responsible for everything done through your account.
  • One person, one account. Tell us immediately at the email above if you suspect unauthorised access.

3. Listing on the Platform (Providers)

3.1 Your responsibilities

If you list something, you promise that:

  • everything in your listing (description, photos, prices, dates, availability, location, contact details, grading and amenities) is accurate, current and not misleading;
  • you own, or have permission to use, every photo and piece of text you upload;
  • you hold every licence, permit, authorisation, insurance and certificate the law requires for what you offer (for example event permits and public-liability cover, liquor licences, accommodation and tourism registrations, safety and fire compliance, and the right to hire out equipment);
  • you will honour the bookings you accept, on the price and terms in your listing, and comply with all applicable laws, including the Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").

3.2 Review and publication

Every listing is submitted for review and is not public until we publish it. We may approve, ask you to change, decline, unpublish or remove any listing at any time, for example if it is inaccurate, incomplete, unlawful, unsafe, misleading, infringes someone's rights, or breaches these Terms. Approval is not an endorsement or verification of the Provider or the listing, and we do not guarantee that any listing will be approved or stay published.

3.3 Listing fees

We may charge a fee to publish or keep a listing live. Where a fee applies, we will tell you the amount before you are asked to pay it, and a listing is published once we have confirmed that the fee has been received and the listing has passed review. Fees are paid to TicketsSA directly, as arranged with you, and not through the Platform. Unless we say otherwise in writing, listing fees are non-refundable once a listing has been published.

3.4 Customer payments

TicketsSA does not collect, hold or process Customer payments for bookings. You arrange payment directly with the Customer (for example by your own payment link or bank transfer details). You are solely responsible for issuing invoices or receipts, accounting for tax, and giving any refund you owe.

3.5 Cancellation and refund policy

You must choose and display a cancellation and refund policy on each listing. You decide it (for example "no refunds" or "50% refund up to 7 days before"), but it must be clear, fair and consistent with the law. See our Refunds & Cancellations page.

3.6 Licence to us

You keep ownership of your content. You give TicketsSA a free, non-exclusive, worldwide licence to host, display, reproduce, resize and promote your listing content (including on our website, emails and social media) for as long as the listing is on the Platform and for a reasonable period afterwards while it is removed from our systems.

4. Booking and enquiring (Customers)

  • When you book or send an enquiry, your details are sent to the Provider and to TicketsSA so the booking can be arranged and supported.
  • A booking or enquiry is not confirmed until the Provider confirms it. Payment is arranged directly with the Provider.
  • Read the listing, including its cancellation and refund policy, before you book. Provider policies apply to your booking.
  • Be honest and respectful, and follow the Provider's reasonable house rules and the law at the venue or property.

5. Prohibited conduct

You may not: post false, fraudulent, unlawful, hateful, obscene or infringing content; list something you are not entitled to offer; collect other users' personal information for unrelated purposes; send spam; interfere with, probe or overload the Platform; bypass security or access controls; scrape the Platform at scale; use the Platform to take payment or contact Customers outside the Platform in order to avoid fees that are due to us; or impersonate any person or business.

6. Our role in disputes

Disputes about a booking (for example quality, cancellations, refunds or no-shows) are between the Customer and the Provider. We may, but are not obliged to, help the parties communicate, and we may remove listings or accounts that attract repeated or serious complaints.

7. Disclaimers

The Platform and all listings are provided "as is" and "as available". We do not verify every listing and we do not guarantee the accuracy, quality, safety, legality or availability of anything listed, or that the Platform will be uninterrupted or error-free. Nothing in these Terms limits any right you have that cannot lawfully be limited, including under the CPA.

8. Limitation of liability

To the maximum extent permitted by law, TicketsSA is not liable for: the acts, omissions, quality, safety or legality of any Provider, event, property, experience, equipment or merchandise; any loss arising from a contract between a Customer and a Provider; or any indirect, incidental, special or consequential loss, or loss of profit, revenue, data or goodwill. Where liability cannot be excluded, our total liability to you for any claim is limited to the greater of R1,000 and the fees you paid to TicketsSA in the 12 months before the claim arose. Nothing in these Terms excludes liability for gross negligence, intentional harm, or anything that the law does not allow us to exclude.

9. Indemnity

You will indemnify TicketsSA against claims, losses and reasonable costs arising from your content or listing, your breach of these Terms or the law, or your dealings with Customers or Providers, except to the extent caused by our own wrongful conduct.

10. Suspension and termination

We may suspend or close an account, or remove content, if we reasonably believe these Terms or the law have been breached, to protect users, or to comply with a legal obligation. You may close your account at any time by emailing us. Sections that by their nature should continue (for example intellectual property, disclaimers, liability and indemnity) survive termination.

11. Intellectual property

The TicketsSA name, logo, design and software are ours or our licensors'. You may not copy or reuse them without our written permission, other than as needed to use the Platform normally.

12. Privacy

We handle personal information in line with our Privacy Policy, which forms part of these Terms.

13. Changes

We may update these Terms. We will change the "last updated" date above, and for material changes we will give notice on the Platform or by email. Continuing to use the Platform after the change means you accept it.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. Please contact us first so that we can try to resolve any complaint informally. Nothing prevents you from approaching the National Consumer Commission, the National Consumer Tribunal, an applicable ombud, or a court of competent jurisdiction in South Africa.

15. General

If any part of these Terms is found unenforceable, the rest remains in force. Our failure to enforce a right is not a waiver of it. These Terms, together with the Privacy Policy and Refunds & Cancellations page, are the whole agreement between you and TicketsSA about the Platform.
